Step by Step Guide to the Bail Bonds Process
When someone is out on bail, they must understand the terms of their release, as violating them can lead to serious consequences such as bail forfeiture. This occurs when a defendant fails to appear in court or meet other conditions after posting a bond, especially if it was through a surety bail bond provided by a bail agency. In some cases, individuals may be granted unsecured bail, which doesn't require upfront payment but still holds them financially accountable if they skip court. Failing to return, commonly known as bail jumping, can result in additional charges and make it harder to obtain release in the future.
1. Arrest and Booking
- When someone is arrested, they are taken to jail for processing.
- This includes fingerprinting, photographing (mugshot), and entering charges into the system.
- A judge sets the bail amount based on the severity of the offense and other factors.
2. Contact a Bail Bonds Agency
- Call a licensed bail bondsman as soon as possible.
- Provide details such as the full name of the arrested person, the jail location, and the charges.
- The bail agent will explain the process and requirements.
3. Sign the Bail Agreement & Pay the Fee
- A co-signer (typically a friend or family member) must sign the bail bond agreement.
- A non-refundable fee is required.
- Collateral (such as property or a vehicle) may sometimes be needed.
4. Bail Bond Is Posted
- Once the paperwork and payment are complete, the bail bondsman submits the bond to the jail.
- Depending on the facility, the jail processes the release, which can take a few hours.
5. Defendant Is Released With Conditions
- The individual is released but must attend all required court appearances.
- Failing to appear in court can lead to re-arrest and forfeiture of the bond.
6. Case Resolution & Bond Exoneration
- The bond is exonerated once the case is resolved (whether through trial, plea, or dismissal).
- If all conditions are met, any collateral is returned to the co-signer.
